4.2 Right of Withdrawal

7.1 The law of the Federal Republic of Germany applies, whereby the UN Convention on Contracts for the International Sale of Goods is excluded.
7.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, Berlin is the exclusive place of jurisdiction for all disputes arising from the contractual relationship.
7.3 Should individual provisions of this contract or the general terms and conditions be or become ineffective, this shall not affect the effectiveness of the rest. In this case, the parties undertake to make a provision that comes closest to the purpose pursued by the omitted provision. The same applies to possible regulation gaps.

A contract between the client (customer) and flowlife / Lutz Urban / Work Life Simple GmbH is concluded when the other contracting party accepts an offer. The contract can be concluded in text form (e.g. fax, e-mail) or – in the case of publicly accessible offers – by booking via your own online shops or third-party online shops connected to the online portal (e.g. digistore24.de).
In the case of in-house offers (not publicly advertised, e.g. within a company) flowlife / Lutz Urban / Work Life Simple GmbH will send the client an offer to carry out the services as a speaker, trainer, coach or consultant in text form (also e-mail) .
The general terms and conditions of Work Life Simple GmbH / flowlife apply exclusively. Conditions of the client that contradict or deviate from these terms and conditions will not be recognized unless their validity has been expressly agreed in writing or in text form. These terms and conditions also apply if Work Life Simple GmbH / flowlife renders its services to the customer without reservation in the knowledge of conflicting or deviating terms and conditions of the client.
2.1 The client / customer safeguards the copyrights of flowlife / Lutz Urban / Work Life Simple GmbH and the experts involved in the programs. This applies in particular to presentations, documents or content that may only be copied, distributed or used for internal or public reproduction or for making publicly available with the written consent of flowlife / Lutz Urban / Work Life Simple GmbH.
2.2 In particular, the provision of the content on publicly accessible platforms such as the company or private website, YouTube, Facebook etc. is not permitted without the written consent of flowlife / Lutz Urban / Work Life Simple GmbH.
2.3 Recording of the event in sound, image or film is only permitted with the prior written consent of flowlife / Lutz Urban / Work Life Simple GmbH.
2.4 The customer does not acquire any rights to use, copy, digitally reproduce or otherwise make the contents of the training, coaching or consulting as well as training or information material commercially available to third parties without the express written consent of flowlife / Lutz Urban / Work Life Simple GmbH . The customer is prohibited from reproducing seminar content in whole or in part.
2.5 If events are filmed by flowlife / Lutz Urban / Work Life Simple GmbH, the customer irrevocably and free of charge consents to all currently known and future media forms that flowlife / Lutz Urban / Work Life Simple GmbH is entitled to image and / or to make, reproduce, send or have sent sound recordings of his person at the respective event and to use them in audiovisual media, also for the purpose of promoting events.
By booking the publicly offered seminars, programs, lectures, coaching or consulting , the following conditions are also accepted by both parties.
3.1 All prices are gross and subject to change. Costs for accommodation, travel to and from the event, for meals and, if applicable, the conference flat rates shown are not included in the seminar price.
3.2For the cancellation of participation in open seminars, events and training and further education, a cancellation fee of 50% is due up to six weeks before the date and then a 100% cancellation fee. The customer is welcome to name a substitute participant up to 14 days before the start of the event. Both regulations only apply if these seminars and events have been booked individually by the customer and not in connection with an online program, such as the flowlife Academy or coaching training. In this case, the customer has no right to withdraw from the live events / seminars. However, the customer can make up for missed seminars on other dates, provided that further dates are offered by flowlife / Lutz Urban / Work Life Simple GmbH. The customer is not entitled to an alternative date.
3.3 flowlife / Lutz Urban / Work Life Simple GmbH reserves the right to cancel seminar dates for important reasons. If a replacement date that is not acceptable for the customer is found, seminar fees that have already been paid will be reimbursed.
3.4 All open seminars or lectures have a minimum and a maximum number of participants. If the maximum number of participants is exceeded, the priority of the receipt of the registration decides on participation. Registration by telephone is not considered binding. If the maximum number of participants is exceeded, the organizer will endeavor to set a follow-up date and reapply. The registered participants are not entitled to such a follow-up appointment.
3.5 If the minimum number of participants is not reached, the event will not take place. The organizer sets the minimum number of participants. We reserve the right to cancel events, e.g. if a lecturer is absent, the number of participants is too low (at least two weeks before the start), the hotel is closed or force majeure is reserved. We endeavor to notify cancellations or necessary changes, in particular a change of the presenter, as early as possible. We expressly reserve the right to make changes to the program as long as the overall character of the event is preserved. 3.6 In the case of coaching and consulting assignments, any of the above and also general cancellation / revocation options do not apply if a booked coaching / consulting has already started, whether in the form of e-mail support, personal or telephone coaching.
When booking the seminars, programs, lectures, coaching or consulting offered in-house, the following additional conditions are mutually accepted:
4.1 Remuneration
4.1.1 All offers are net offers, VAT is also shown. In the case of in-house events, additional travel costs are incurred in your own car or flight, train, expenses and, if applicable, accommodation costs.
4.1.2 For in-house events, the services of flowlife / Lutz Urban / Work Life Simple GmbH will be invoiced promptly after the event. Invoices are to be paid immediately without deduction.
4.2 Withdrawal / cancellation
4.2.1 In the event of a withdrawal from the order or if an in-house event (training, coaching, consulting) does not take place, the client will notify flowlife / Lutz Urban / Work Life Simple GmbH of this immediately.
4.2.2 There is no cancellation fee for cancellations up to eight weeks before the in-house appointment. For cancellations up to four weeks before the appointment, 50% of the agreed fee must be paid. For cancellations within less than four weeks, 80% of the agreed fee will be charged.
4.2.3 If the client offers an alternative date that is acceptable to flowlife / Lutz Urban / Work Life Simple GmbH, no cancellation fee will be charged. However, this has to be decided by flowlife / Lutz Urban / Work Life Simple GmbH on a case-by-case basis, taking into account the client’s legitimate interests.
4.2.4 flowlife / Lutz Urban / Work Life Simple GmbH reserves the right to cancel seminar dates for important reasons. If a replacement date that is not acceptable for the customer is found, fees already paid will be reimbursed.
4.3 Withdrawal / cancellation by flowlife / Lutz Urban / Work Life Simple GmbH / event cancellation
4.3.1 If a trainer, coach or consultant is unable to carry out his assignment due to force majeure, illness, accident or other circumstances that are not his fault, he will inform the client immediately.
4.3.2 Further damages are excluded. This exclusion does not apply in the event of willful or grossly negligent behavior or in the event of injury to life, body or health of the client.
4.3.3 If the appointment is canceled, no fees will be charged by flowlife / Lutz Urban / Work Life Simple GmbH.
4.4 Technical equipment for the presentation
4.4.1 Unless otherwise agreed, the client of in-house events provides the necessary technology for the seminars. The requirements will be communicated to the client at least 14 days before the event date by flowlife / Lutz Urban / Work Life Simple GmbH.
4.4.2 If this is not possible for the client, he will inform flowlife / Lutz Urban / Work Life Simple GmbH as early as possible so that a suitable solution can be found. If necessary, additional rental fees will then be incurred, which must be borne by the client.

33. Legal basis for processing
Art. 6 I lit. a GDPR serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. Profiling ist jede Art der automatisierten Verarbeitung personenbezogener Daten, die darin besteht, dass diese personenbezogenen Daten verwendet werden, um bestimmte persönliche Aspekte, die sich auf eine natürliche Person beziehen, zu bewerten, insbesondere, um Aspekte bezüglich Arbeitsleistung, wirtschaftlicher Lage, Gesundheit, persönlicher Vorlieben, Interessen, Zuverlässigkeit, Verhalten, Aufenthaltsort oder Ortswechsel dieser natürlichen Person zu analysieren oder vorherzusagen.
Pseudonymisierung ist die Verarbeitung personenbezogener Daten in einer Weise, auf welche die personenbezogenen Daten ohne Hinzuziehung zusätzlicher Informationen nicht mehr einer spezifischen betroffenen Person zugeordnet werden können, sofern diese zusätzlichen Informationen gesondert aufbewahrt werden und technischen und organisatorischen Maßnahmen unterliegen, die gewährleisten, dass die personenbezogenen Daten nicht einer identifizierten oder identifizierbaren natürlichen Person zugewiesen werden.
Verantwortlicher oder für die Verarbeitung Verantwortlicher ist die natürliche oder juristische Person, Behörde, Einrichtung oder andere Stelle, die allein oder gemeinsam mit anderen über die Zwecke und Mittel der Verarbeitung von personenbezogenen Daten entscheidet. Sind die Zwecke und Mittel dieser Verarbeitung durch das Unionsrecht oder das Recht der Mitgliedstaaten vorgegeben, so kann der Verantwortliche beziehungsweise können die bestimmten Kriterien seiner Benennung nach dem Unionsrecht oder dem Recht der Mitgliedstaaten vorgesehen werden.

Empfänger ist eine natürliche oder juristische Person, Behörde, Einrichtung oder andere Stelle, der personenbezogene Daten offengelegt werden, unabhängig davon, ob es sich bei ihr um einen Dritten handelt oder nicht. Behörden, die im Rahmen eines bestimmten Untersuchungsauftrags nach dem Unionsrecht oder dem Recht der Mitgliedstaaten möglicherweise personenbezogene Daten erhalten, gelten jedoch nicht als Empfänger.
Dritter ist eine natürliche oder juristische Person, Behörde, Einrichtung oder andere Stelle außer der betroffenen Person, dem Verantwortlichen, dem Auftragsverarbeiter und den Personen, die unter der unmittelbaren Verantwortung des Verantwortlichen oder des Auftragsverarbeiters befugt sind, die personenbezogenen Daten zu verarbeiten.
Einwilligung ist jede von der betroffenen Person freiwillig für den bestimmten Fall in informierter Weise und unmissverständlich abgegebene Willensbekundung in Form einer Erklärung oder einer sonstigen eindeutigen bestätigenden Handlung, mit der die betroffene Person zu verstehen gibt, dass sie mit der Verarbeitung der sie betreffenden personenbezogenen Daten einverstanden ist.

Zur Auslieferung und Steuerung der nachfolgend beschriebenen Dienste nutzen wir zusätzlich ein serverseitiges Tag-Management. Die Daten werden zunächst an unseren eigenen Endpunkt dt.certycoach.com übermittelt und von dort an die jeweiligen Anbieter weitergeleitet. Betreiber der dafür eingesetzten Infrastruktur ist die Stape Europe OÜ, Sepapaja tn 6, 15551 Tallinn, Estland (Registercode 16564377). Die Verarbeitung erfolgt auf Servern in den Niederlanden und damit innerhalb der Europäischen Union.
Der Vorteil dieses Verfahrens: Wir können vor der Weitergabe steuern, welche Daten den jeweiligen Anbieter erreichen. Dabei entstehen First-Party-Cookies auf unserer eigenen Domain (siehe unten: FPID, FPGSID, FPLC, FPAU). Verarbeitet werden IP- Adresse, Geräte- und Browserinformationen sowie die Ereignisdaten der jeweiligen Dienste.
Rechtsgrundlage: Die Weiterleitung erfolgt für jeden Dienst auf derselben Grundlage wie der Dienst selbst (Einwilligung nach Art. 6 Abs. 1 lit. a DSGVO). Mit dem Anbieter besteht ein Auftragsverarbeitungsvertrag nach Art. 28 DSGVO.

Bei mehreren der nachfolgend genannten Dienste können personenbezogene Daten in die USA übermittelt werden. Die Europäische Kommission hat mit Beschluss vom 10.07.2023 festgestellt, dass in den USA für Unternehmen, die unter dem EU-U.S. Data Privacy Framework zertifiziert sind, ein angemessenes Datenschutzniveau besteht (Art. 45 DSGVO).
Google LLC, Microsoft Corporation, Meta Platforms, Inc. und Zapier, Inc. sind unter dem Data Privacy Framework zertifiziert. Ein Restrisiko lässt sich dennoch nicht vollständig ausschließen: US-Behörden können unter bestimmten Voraussetzungen auf Daten zugreifen, und wirksame Rechtsbehelfe stehen Betroffenen nur eingeschränkt zur Verfügung. Sie erteilen Ihre Einwilligung daher zugleich für die Übermittlung in die USA im Sinne von Art. 49 Abs. 1 lit. a DSGVO.
Für Anbieter ohne DPF-Zertifizierung stützen wir die Übermittlung auf Standardvertragsklauseln nach Art. 46 Abs. 2 lit. c DSGVO.
Zur Verwaltung Ihrer Einwilligung setzen wir Borlabs Cookie ein (Borlabs GmbH, Rübenkamp 32, 22305 Hamburg). Gespeichert werden Ihre Auswahl, der Zeitpunkt der Einwilligung, eine anonyme Kennung und die Version des Einwilligungstextes. Wir schalten Werbung über Meta (Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Irland) und setzen dazu den Meta-Pixel sowie die Conversions API ein. Gespeichert werden die von Ihnen übermittelten Kontaktdaten, der Inhalt Ihrer Anfrage, der weitere Schriftwechsel sowie Notizen unserer Mitarbeitenden zum Bearbeitungsstand. Wenn Sie über eine Anzeige auf unsere Website gelangen, wird eine Kennung übergeben, die den Klick auf diese Anzeige bezeichnet. Je nach Plattform sind das die Parameter gclid, gbraid oder wbraid (Google Ads), msclkid (Microsoft Advertising) sowie die aus dem Parameter fbclid gebildeten Werte _fbc und _fbp (Meta). Diese Kennungen speichern wir zusammen mit Ihrer Anfrage in unserem Kundenverwaltungssystem.
Führt eine Anfrage später zu einem Vertragsabschluss, übermitteln wir diesen Abschluss zusammen mit der jeweiligen Kennung an die entsprechende Werbeplattform (siehe Abschnitte 13.2, 13.5 und 13.7). So können wir bewerten, welche Kampagnen tatsächlich zu Abschlüssen führen. Übermittelt werden die Kennung, der Zeitpunkt und die Art der Conversion. Die technische Übertragung erfolgt über die oben genannten Automatisierungsdienste.
Zusätzlich übermitteln wir Ihre E-Mail-Adresse und, sofern angegeben, Ihre Telefonnummer in verschlüsselter Form (SHA-256-Hash) an die jeweilige Werbeplattform. Diese Werte dienen ausschließlich dazu, den Abschluss dem ursprünglichen Anzeigenkontakt zuzuordnen. Klartextdaten übermitteln wir nicht. Rechtsgrundlage: Art. 6 Abs. 1 lit. a DSGVO (Ihre Einwilligung in das jeweilige Werbe- Tracking). Wir verarbeiten Ihre personenbezogenen Daten auf folgenden Grundlagen:

– Art. 6 Abs. 1 lit. c DSGVO, soweit wir einer rechtlichen Verpflichtung unterliegen – etwa steuer- und handelsrechtlichen Aufbewahrungspflichten.
– Art. 6 Abs. 1 lit. f DSGVO auf Grundlage unserer berechtigten Interessen. Diese liegen im sicheren und störungsfreien Betrieb unserer Website, in der Abwehr von Missbrauch sowie in einer nachvollziehbaren und ordentlichen Bearbeitung von Anfragen. Ihr Widerspruchsrecht nach Art. 21 DSGVO bleibt davon unberührt (siehe Ziffer 4). Welche Grundlage im Einzelfall gilt, ist bei jedem Verarbeitungsvorgang in dieser Erklärung angegeben.
Wie lange wir Ihre Daten speichern, richtet sich nach dem jeweiligen Zweck und den gesetzlichen Aufbewahrungsfristen. Handels- und steuerrechtliche Unterlagen bewahren wir nach § 257 HGB und § 147 AO sechs bzw. zehn Jahre auf. Die Fristen für die einzelnen Verarbeitungen sind im jeweiligen Abschnitt genannt.
Die Angabe personenbezogener Daten ist teils gesetzlich vorgeschrieben, teils vertraglich erforderlich. Ohne diese Angaben können wir einen Vertrag mit Ihnen nicht schließen oder Ihre Anfrage nicht bearbeiten. In unseren Formularen sind die dafür erforderlichen Felder als Pflichtfelder gekennzeichnet; alle übrigen Angaben sind freiwillig und wirken sich nicht nachteilig auf Sie aus.
Eine automatisierte Entscheidungsfindung im Sinne von Art. 22 DSGVO findet nicht statt. Über Ihre Anfragen und über die Aufnahme in unsere Ausbildungen entscheiden ausschließlich Menschen.
Im Rahmen der in Ziffer 12 und 13 beschriebenen Analyse- und Werbedienste findet jedoch ein Profiling im Sinne von Art. 4 Nr. 4 DSGVO statt: Ihr Nutzungsverhalten wird ausgewertet, um Zielgruppen zu bilden und Werbung auszusteuern. Diese Verarbeitung erfolgt ausschließlich auf Grundlage Ihrer Einwilligung und hat keine rechtliche Wirkung Ihnen gegenüber. Sie können die Einwilligung jederzeit widerrufen.
§ 1 Geltungsbereich/anwendbares Recht
(1) Diese allgemeinen Geschäftsbedingungen sind Bestandteil aller Angebote und Verträge einschließlich zu Seminaren und Veranstaltungen zwischen den Kunden und Work Life Simple GmbH. Entgegenstehende oder von diesen AGB abweichende Bedingungen des Kunden erkennt Work Life Simple GmbH nicht an, es sei denn, Work Life Simple GmbH hätte ausdrücklich schriftlich ihrer Geltung zugestimmt. Unsere AGB gelten auch dann, wenn Work Life Simple GmbH in Kenntnis entgegenstehender oder von unseren AGB abweichenden Bedingungen des Kunden die Leistung an den Kunden vorbehaltlos ausführen. Unsere AGB gelten auch für alle künftigen Vereinbarungen mit dem Kunden.
(2) Alle Vereinbarungen, die zwischen Work Life Simple GmbH und dem Kunden getroffen werden, bedürfen zu ihrer Wirksamkeit der Schriftform oder der Ausführung gemäß § 2 Abs. 3 dieser AGB. Ausnahmen bleiben unbenommen.
§ 2 Angebote/Vertragsgegenstand/Vertragsabschluss/Leistungsfristen
(1) Die Angebote der Work Life Simple GmbH sind freibleibend, d.h. nur eine Aufforderung zur Abgabe eines Angebotes.
(2) Die Online u.a. dargestellten einzelnen Leistungsarten enthalten eine vollständige und detaillierte Beschreibung insbesondere der Coaching- und Seminarleistungen, sind jedoch unverbindlich.
(3) Eine verbindliche Bestellung der in den Angeboten enthaltenen einzelnen Leistungsarten kommen durch die ausdrückliche Bestätigung der Kenntnisnahme der geltenden AGB nebst Widerrufsbelehrung sowie durch Anklicken des Buttons „Kaufen“ und „Zahlungspflichtig bestellen“, der Übersendung des ausgefüllten Anmeldebogens und/oder mit Zugang der schriftlichen Auftragsbestätigung (vorzugsweise per eMail) durch Work Life Simple GmbH beim Kunden zustande.
(4) Eine verbindliche Auftragsbestätigung kommt ebenfalls zustande, wenn der Kunde nach ausdrücklicher vorheriger Belehrung das von ihm bestimmte relevante Angebot im Rahmen einer telefonischen sprachlichen Aufzeichnung telefonisch mündlich bestätigt. Diese telefonische Aufzeichnung wird mindestens bis zur ordnungsgemäßen Beendigung der Geschäftsbeziehung gespeichert.
(5) Ein schriftlicher Vertragsschluss ist ferner durch die Buchung über den eigenen oder angeschlossene online-shops von Fremdanbietern zulässig.
(6) Bei Inhouse Angeboten (nicht öffentlich ausgeschriebene Angebote) erhält der Kunde von Work Life Simple GmbH ein schriftliches Angebot der Leistungen insbesondere als Referent, Trainer, Coach oder Consultant, welches dann schriftlich durch den Kunden zum Vertragsschluss zu bestätigen ist.
(7) Die Leistungsfristen ergeben sich aus dem jeweiligen speziellen Leistungsangebot zur Leistungsart.
§ 3 Preise
(1) Unsere Preise ergeben sich aus der aktuellen Preisliste zum speziellen Leistungsangebot.
(2) Die Gewährung einer Zahlungserleichterung (Ratenzahlung) bedarf der individuellen Vereinbarung.
(3) Preise gelten erst ab Vertragsschluss als Festpreis.
§ 4 Rücktritt/Stornierungen
(1) Wir sind u.a. berechtigt von einem bereits geschlossenen Vertrag zurückzutreten, wenn
(2) Im Fall gem. Abs. 1 werden wir den Kunden unverzüglich von der Nichtverfügbarkeit der Leistungsart informieren. Bereits gezahlte Teilnahmegebühren werden zurückerstattet.
(3) Bei Stornierungen von Verträgen für öffentlich ausgeschriebene Einzelseminare, Veranstaltungen, Vorträge, Coachings oder Consultings fallen bis 6 Wochen vor dem Termin 50 %, danach 100 % Stornogebühr auf die Gesamtkosten an.
(4) Bei Stornierungen bei Inhouse Verträgen (für Unternehmen und Organisationen) fallen bis 8 Wochen vor dem Termin keine Stornogebühren, bis 4 Wochen vor dem Termin 50 %, danach 80 % Stornogebühr auf die Gesamtkosten an.
(5) Die unter den Absätzen 3 und 4 festgelegten Stornierungsbestimmungen gelten ausschließlich für die dort angeführten Vereinbarungen. Für alle anderen Verträge, wie mehrmonatige Ausbildungen, insbesondere zum Life- und Businesscoach, Teamcoach, Mastercoach oder Online-Programme gelten die Widerrufsbestimmungen gem. § 11 dieser AGB.
§ 5 Zahlungsbedingungen
(1) Sofern sich aus der Auftragsbestätigung nichts anderes ergibt, ist der gesamte Preis sofort fällig. Verzug tritt ohne weitere Mahnung ein, wenn der Kunde keine Zahlung auf das erste vertraglich vereinbarte Zahlungsziel leistet.
(2) Bei Vorliegen der Voraussetzungen kann dem Kunden Zahlungserleichterung durch angemessene Ratenzahlung gewährt werden. Rechtsanspruch des Kunden hierauf besteht nicht.
(3) Die Work Life Simple GmbH ist berechtigt, die Ausführung ihrer Leistung vom Zahlungseingang (auch der jeweiligen Raten) abhängig zu machen.
(4) Im Fall einer Mahnung entsteht eine Gebühr in Höhe von € 5,00, deren Zahlungspflicht lediglich bei der ersten Mahnung nicht besteht, sofern diese verzugsbegründet ist.
(5) Bei Zahlungsschwierigkeiten des Kunden, z.B. Zahlungsverzug, sind wir berechtigt, alle ggfls. offenstehenden und gestundeten Rechnungsbeträge sofort fällig zu stellen.
§ 6 Leistungserbringung
(1) Die Leistungserbringung erfolgt gem. der speziellen Leistungsart insbesondere als Coaching, Teilnahme an Seminaren, Konsultationen, der Bereitstellung von digitalen Produkten ggfls. einschließlich nach individueller Vereinbarung.
(2) Beginn der Leistungserbringung gem. Vereinbarung erfolgt nach rechtswirksamem Vertragsabschluss und Zahlung des vereinbarten Preises. Bei Gewährung von Ratenzahlung ist der Zeitpunkt des Einganges der ersten Rate maßgeblich.
(3) Work Life Simple GmbH ist es ausdrücklich gestattet, im Rahmen der Leistungserbringung Video-, Bild- und Tonaufnahmen von Kunden vorzunehmen. Eine weitere Verwendung der Video-, Bild- und Tonaufnahmen ist Work Life Simple GmbH im Rahmen der Leistungserbringung sowie für Werbemaßnahmen auf alle bekannten und unbekannten Nutzungsarten unbeschränkt und unentgeltlich Die Einwilligung ist räumlich und zeitlich nicht beschränkt.
(4) Die angebotenen und erbrachten Leistungen sind keine medizinische, therapeutische oder rechtliche Beratung und auch nicht als solche auszulegen. Hierzu werden die Kunden auf die dafür geltenden gesetzlichen Bestimmungen verwiesen.
§ 7 Gewährleistung
Die Gewährleistung richtet sich nach den gesetzlichen Bestimmungen.
§ 8 Haftungsbeschränkung/Haftungsausschluss
(1) Die Haftung aus Vertragsverletzungen ist ausschließlich auf Vorsatz und grobe Fahrlässigkeit nach den gesetzlichen Vorschriften und auf einen Gesamtbetrag von € 15.000,00 beschränkt.
(2) Soweit unsere Haftung ausgeschlossen oder beschränkt ist, gilt dies insbesondere auch für die persönliche Haftung unserer Angestellten, Arbeitnehmer, Mitarbeiter, Vertreter und Erfüllungsgehilfen.
(3) Aus den angebotenen Leistungsarten schuldet Work Life Simple GmbH dem Kunden keinerlei Erfolgs- oder andere Garantien, gleich aus welchem Rechtsgrund.
§ 9 Vertragsausführung, Urheber- und Nutzungsrechte
(1) Alle Inhalte der Leistungsarten sind urheberechtlich geschützt. Insbesondere eine Weitergabe, Veröffentlichung und gewerbliche Nutzung ohne ausdrückliche schriftliche Zustimmung durch Work Life Simple GmbH / CertyCoach ist nicht gestattet.
(2) Nach Vertragsschluss und vereinbarter Zahlung erhält der Kunde personalisierte Zugangsdaten. Der Kunde hat Sorge dafür zu tragen und haftet auch dafür, dass die Nutzung des Internet-Zugangs und der damit verbundenen Inhalte ausschließlich durch ihn persönlich erfolgt. Die Nutzung ist nicht übertragbar. Verstöße werden unverzüglich zivil- und/oder strafrechtlich verfolgt.
§ 10 Bundesdatenschutzgesetz, SCHUFA und Auskunfteien
(1) Bei allen Vorgängen der Datenverarbeitung (zum Beispiel Erhebung, Verarbeitung und Übermittlung in Ausbildungsprogrammen) verfahren wir nach den gesetzlichen Vorschriften. Verwendet werden ausschließlich Kundendaten, die für die Vertragsabwicklung notwendig sind. Im Übrigen gelten die Bestimmungen des Bundesdatenschutzgesetzes (BDSG).
(2) Im Rahmen des gesetzlich zulässigen und unter Berücksichtigung ihrer jeweiligen schutzwürdigen Interessen an dem Ausschluss der Übermittlung oder Nutzung können wir zu Bonitäts- und Kreditprüfungen während der Dauer der Kundenbeziehung Adress- und Bonitätsdaten gegebenenfalls an die SCHUFA oder andere Auskunfteien weitergeben (z.B. bei Prüfung auf Ratenzahlungsgewährung).
§ 11 Widerrufsbelehrung
(1) Der Kunde als Verbraucher gem. § 13 BGB hat das Recht, binnen einer Frist von 14 Tagen nach Vertragsschluss ohne Angabe von Gründen den Vertrag zu widerrufen.
(2) Das Widerrufsrecht kann ausgeübt werden, indem per e-mail an info@certycoach.com durch eine eindeutige Erklärung der Widerruf erklärt wird.
(3) Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufes.
(4) Aus wichtigem Grund herrührende Kündigungsrechte des Kunden bleiben vom Widerrufsrecht unberührt.
(5) Das Widerrufsrecht des Kunden erlischt gemäß § 356 Abs. 4 BGB bereits vor Ablauf der zweiwöchigen Widerrufsfrist regelmäßig dann, wenn Work Life Simple GmbH mit der Ausführung der vereinbarten Leistung mit ausdrücklicher Zustimmung des Kunden bereits begonnen hat oder wenn der Käufer die Erbringung der vereinbarten Leistung selbst veranlasst hat.
(6) Bei wirksam erklärten Widerruf des Vertragsschlusses sind beiderseitig empfangene Leistungen im Rahmen der gesetzlichen Vorschriften, sofern tatsächlich möglich, zurückzugewähren. Work Life Simple GmbH wird für die Rückzahlung etwaige zurückzugewährender Entgelte dasselbe Zahlungsmittel einsetzen, welches der Nutzer ursprünglich eingesetzt hatte. Abweichungen hiervon gelten allein dann, wenn etwas hiervon abweichendes ausdrücklich vereinbart wurde. In keinem Fall werden Entgelte für gewährende Rückzahlungen berechnet.
§ 12 Schlussbestimmung
(1) Sollten eine oder mehrere Bestimmungen dieser AGB rechtsunwirksam sein oder in Zukunft rechtsunwirksam werden, so wird die Gültigkeit der übrigen Bestimmungen hiervon nicht berührt. Die unwirksamen bzw. unwirksam gewordenen Bestimmungen sind durch solche zu ersetzen, die dem gewollten Zweck und den gesetzlichen Bestimmungen entsprechen.
(2) Es wird die Geltung deutschen Rechts vereinbart.
(3) Als Gerichtsstand wird, sofern zulässig, Berlin vereinbart.
